ಬೆಳಗಾವಿ: ನ್ಯಾಯ ವಿಧಾನವು ಬದಲಾದಂತೆ ಇತ್ತೀಚಿನ ದಿನಗಳಲ್ಲಿ ಪರ್ಯಾಯ ವಿವಾದ ಪರಿಹಾರ ವ್ಯವಸ್ಥೆಯುನ್ಯಾಯಾಂಗ ವ್ಯವಸ್ಥೆಯಲ್ಲಿ ತನ್ನದೇ ಆದ ಛಾಪನ್ನು ಮೂಡಿಸಿದೆ. ಪಕ್ಷಗಾರರ ನಡುವಿನ ವಿವಾದವನ್ನು ಸುಲಭವಾಗಿ ತನ್ನದೇ ವಿಶಿಷ್ಟ ಶೈಲಿಯ ಕ್ರಮ ವಿಧಾನಗಳಾದ ‘ಮಾತುಕತೆ’ ಹಾಗೂ ‘ಮಧ್ಯಸ್ಥಿಕೆ’ ಮೂಲಕ ಶೀಘ್ರವಾಗಿ ಪರಿಹರಿಸುತ್ತದೆ. ಇದನ್ನು ವಿವಾದಗಳ ವಿವಿಧ ಶ್ರೇಣಿಗೆ ಅನ್ವಯಿಸಿ, ಪರಿಹಾರ ಕಂಡುಕೊಳ್ಳಲು ಸೂಕ್ತ ವೇದಿಕೆಯಾಗಿದೆ. ಜೊತೆಗೆ ಸಂಧಾನವು ಸ್ವಯಂ ಪ್ರೇರಿತ ನ್ಯಾಯ ಪ್ರಕ್ರಿಯೆಯಾಗಲಿ ಎಂದು ಕರ್ನಾಟಕ ಉಚ್ಚ ನ್ಯಾಯಾಲಯದ ನ್ಯಾಯಮೂರ್ತಿ ಎಂ.ಜಿ.ಎಸ್ ಕಮಲ್ ಅಭಿಪ್ರಾಯಪಟ್ಟರು.
ನಗರದ ರಾಜಾ ಲಖಮಗೌಡ ಕಾನೂನು ವಿದ್ಯಾಲಯದ ಕೆ.ಕೆ. ವೇಣುಗೋಪಾಲ್ ಸಭಾಂಗಣದಲ್ಲಿ ಶನಿವಾರ ಪರ್ಯಾಯ ವಿವಾದಗಳ ಪರಿಹಾರ ವ್ಯವಸ್ಥೆ – ಹೊಸ ಪ್ರವೃತ್ತಿಗಳು, ಸಮಕಾಲೀನ ಸವಾಲುಗಳು ಮತ್ತು ಭವಿಷ್ಯ ಎಂಬ ವಿಷಯದ ಕುರಿತ ರಾಷ್ಟ್ರಮಟ್ಟದ ವಿಚಾರ ಸಂಕಿರಣದಲ್ಲಿ ಮಾತನಾಡಿದರು.
ಅಧ್ಯಕ್ಷತೆ ವಹಿಸಿದ್ದ ಹಿರಿಯ ನ್ಯಾಯವಾದಿ ಹಾಗೂ ಕರ್ನಾಟಕ ಲಾ ಸೊಸೈಟಿಯ ಅಧ್ಯಕ್ಷ ಅನಂತ ಮಂಡಗಿ ಮಾತನಾಡಿ, ಉದಯೋನ್ಮುಖ ವಕೀಲರು ಅಗತ್ಯ ಬಿದ್ದರೆ ತಮ್ಮ ಕಕ್ಷಿದಾರರಿಗೆ ಸಂಧಾನ ಅಥವಾ ಮಧ್ಯಸ್ಥಿಕೆಯ ಮೂಲಕ ಪ್ರಕರಣಗಳನ್ನು ಶೀಘ್ರ ಇತ್ಯರ್ಥಪಡಿಸಿ, ನ್ಯಾಯ ದೊರಕಿಸಿ ಕೊಡುವಲ್ಲಿ ಪ್ರಾಮಾಣಿಕವಾಗಿ ಕಾರ್ಯೊನ್ಮುಖರಾಗಬೇಕೆಂದು ಹೇಳಿದರು.
ವಿಚಾರ ಸಂಕೀರ್ಣದಲ್ಲಿ ದೇಶದಾದ್ಯಂತ ಹತ್ತಾರು ವಿಶ್ವವಿದ್ಯಾಲಯಗಳ ನಲವತ್ನಾಲ್ಕು ಪ್ರತಿನಿಧಿಗಳು ಭಾಗವಹಿಸಿ, 65ಕ್ಕೂ ಹೆಚ್ಚಿನ ಪ್ರಬಂಧಗಳನ್ನು ಮಂಡಿಸಿದರು.
ಕಾಲೇಜಿನ IQAC ಹಾಗೂ ಸೆಮಿನಾರ್ ವಿಭಾಗದಿಂದ ಆಯೋಜಿಸಲಾಗಿದ್ದ ಕಾರ್ಯಕ್ರಮವನ್ನು ಪ್ರಾಚಾರ್ಯ ಡಾ. ಎ. ಎಚ್ ಹವಾಲ್ದಾರ್ ಸ್ವಾಗತಿಸಿ, ಸಭಿಕರಿಗೆ ಕಾಲೇಜಿನ ಸಾಧನೆಯನ್ನು ಪರಿಚಯಿಸಿದರು.

Belagavi: KLS Raja Lakhamgouda Law College organized A National Level Conference on ADRS [Alternative Dispute Resolution System] under IQAC Initiative. Hon’ble Justice M.G Shukure Kamal, Judge, High Court of Karnataka Dharwad Bench was the Chief Guest of the function. Addressing the Conference, he quoted the famous quote of Abraham Lincoln “Discourage litigation Persuade your neighbor to compromise whenever you can. As a peace maker, the lawyer has the superior authority of being a good man. There will still be business enough” He highlighted the benefits of ADRS. Alternative Dispute Resolution System is flexible, Economical, and consumes less Time and less dependency on courts. Law students have greater future in this system he said.
Senior Advocate Anant Mandgi, President Karnatak Law Society was President for the function. In his Presidential remarks he expressed his view on ADRS. “Justice delayed is justice denied” is the base for ADRS he said. ADRS contains two types Binding and Non-Binding. Mediation and Conciliation are Non-Binding whereas Arbitration is binding. The client should go through negotiation before entering into litigation.
